Halle Berry didn’t stay silent. Hours after her ex-husband Olivier Martinez accused her of assaulting their 12-year-old son, Maceo, and a Los Angeles judge granted him a temporary restraining order, her attorney responded. According to Martinez’s declaration, on the night of September 26, Berry allegedly jumped on the boy and put her hands around his neck. He says Maceo called him asking him to pick him up, and that he heard panic in his voice and screams in the background. He is also seeking sole custody and alleges previous incidents of physical, verbal, and emotional abuse.

The response from Marina Beck, the actress’s attorney, was direct: saying the request is meritless and deliberately misleading would be an understatement. She says there is extensive evidence, including several court rulings, that Martinez violated court orders and interfered with Maceo’s therapies and educational support, and that he has already been legally sanctioned for it. She adds that this action doesn’t surprise her coming from someone with a well-documented history of erratic, possessive, and violent behavior. Beck didn’t cite any specific incident. TMZ believes she could be referring to the 2012 Thanksgiving fight with Gabriel Aubry, Berry’s former partner, who said Martinez threatened to kill him and beat him. The actress’s side denied that account at the time and maintained that Aubry was the aggressor.

For now, the order requires Berry to stay 100 yards away from Martinez, but the judge hasn’t blocked her from having contact with her son. Everything remains on hold until the October 16 hearing. Martinez’s attorney says he is only seeking the child’s safety and for her to get help managing her anger. Who’s telling the truth?
