“If you gave birth, you are not a father, you are the mother” The judge denied the first “pregnant man” a divorce, ruling that he is still a woman

He had 3 children and changed his legal identity to male, but when he asked for a divorce, the state refused to recognize his gender: does biology or the law define parenthood? ⚖️🤰🏻👨‍👦

In 2008, the whole world was stunned when Thomas Beatie, a trans man from the United States, appeared on television showing his pregnant belly. Thomas had medically and legally transitioned to male years earlier. However, because his wife was infertile, he decided to temporarily suspend his hormone treatment so he could use the reproductive organs he still had and give birth to the couple’s three children. What no one imagined was that the real drama would not be in the operating room, but in the courtrooms.

Years later, when the couple decided to separate and file for divorce in the state of Arizona, a family court judge abruptly halted the process with a ruling that sparked fierce international debate: the court refused to recognize Thomas as a man.

According to the judge’s controversial ruling, the fact that Thomas had given birth to his children showed that biologically, he had acted as the mother of the family. Therefore, under that state’s law, the union was considered a “marriage between two women”, a legal arrangement that was prohibited in Arizona at the time, which legally invalidated their marriage and prevented them from getting divorced.

For Thomas, the decision was a humiliating blow: “They put my identity on trial. It wasn’t just about being respected as a man; it was about affirming that I am the father of my children and that they were born within a legal marriage”, he said after beginning an exhausting legal battle that lasted more than three years and 1.295 days.

Although the Arizona Court of Appeals later overturned the ruling and recognized his male identity in granting him a divorce, the case left a social rift that continues to divide public opinion to this day:

On one side, the most conservative groups argue that the biological ability to gestate and breastfeed belongs exclusively to females, maintaining that a court cannot erase basic biology to call someone who gave birth a “father”.

On the other side, trans rights advocates say that gender identity and legal documents take precedence over reproductive organs, and that denying a trans man fatherhood is an act of ideological discrimination.

A landmark case that pushed the limits of law, science, and human identity to the point of highest tension.

Do you think parenthood should be defined by the biology of childbirth or by a person’s legal identity?
