David Anthony Burke, known in music as D4VD, has already been sent to trial in Los Angeles. A judge determined that there is sufficient evidence for the case to move forward, and he now faces three charges: murder, abuse, and unlawful mutilation of human remains.
The victim is Celeste Rivas Hernández, 14. According to prosecutors, Burke attacked her after perceiving her as a threat to his artistic career. District Attorney Nathan J. Hochman confirmed on July 27 that the defendant legally meets the requirements for the death penalty to be considered, although he clarified that there is still no final decision on whether to seek it.
Burke pleaded not guilty to all charges. His legal team will be able to present arguments before prosecutors decide whether to seek execution or life imprisonment without parole. The next hearing is set for August 31, while the defendant remains in pretrial detention.
